Annual report on the activities of the Office for Intervention and Legal Counsel of Marek Kuchciński MP in Przemyśl

From January 2017 through December 2017, the Office held  584 meetings.

Counseling was provided in the areas of:

  1. administrative law;
  2. general scope of civil law;
  3. criminal and misdemeanor law;
  4. labor and social security law;
  5. family law;

The largest amount of advice in 2017 was for civil law cases, which were 284. The smallest percentage of problems with which the parties reported concerned the subject of labor law and social security - 53, and criminal cases - 62.

The most common topics discussed in civil cases were widely understood inheritance matters. They concerned the issues of inheritance acquisition, its division, or the right to remain. The parties also frequently raised the issue of prescription of claims and the possibility of avoiding the legal consequences of contracts concluded by them. A great deal of attention was also devoted to the subject of consumer bankruptcy.

Both victims and suspects/defendants came forward in criminal cases. The issues raised concerned, in particular, notifications of the possibility of committing crimes, e.g. fraud, abuse of power, or realization of the right to defense. For those seeking representation, the Office prepared motions for the appointment of a professional defender ex officio.

Family matters focused mainly on the problems of alimony, both the possibility of obtaining it and evading the obligation to pay it. There were also issues of divorce proceedings or contact with minor children.

As far as the subject matter of administrative law is concerned, it is not possible to single out a group of predominant cases discussed by the Office for Legal Intervention and Advice, due to its diversity. They concerned, inter alia, issues in the field of social welfare, including "500 +" parental benefit, or construction law related to obtaining land development conditions. Tax issues were also discussed.

Labour and social insurance law was the subject of meetings concerning broadly defined pensions, whether on account of inability to work or survivor benefits. In connection with the change of pension regulations, there were also matters concerning obtaining the right to a pension and its amount.
